REVISIT FLAG
REGULATIONS
Over the years, many associations have enacted a regulation
prohibiting the flying of flags and banners, including the American
flag. Some of these regulations were aimed at preventing damage to
building exteriors. Others were enacted to promote a uniform exterior
appearance or in fear that permitting an American flag would open the
door to all other types of flags. Regardless of the reason, now is the
time to revisit the flag regulations of your community.
Since September 11th, the American flag has again taken prominence as
our national symbol. Understandably, it is appearing everywhere and
the national trend is showing no signs of letting up.
At this unique time in our nation’s history, boards should take a new
look at their association’s flag flying restrictions with the aim of
supporting America and avoiding community conflict. Rather than an
outright ban, boards should consider developing regulations for
permitting the flying of the American flag. Such regulations should
include rules of American flag etiquette, size, placement, and
installation requirements.
Revisiting flag regulations will balance the patriotic interest of the
residents with the association’s duty to maintain and administer the
property.
